Welcome! This agreement explains how you can use photos purchased and downloaded from The Sky Refinery.

License Types:

• Standard License (included with all downloads): Allows personal and commercial use with limitations (explained below).
• Extended License (contact via email to purchase separately): Grants additional rights like unlimited use and product resale.

How You Can Use Licenced Content:

• Perpetual, meaning there is no expiration or end date on your rights to use the content downloaded during your agreement.
• Non-exclusive, meaning that you do not have exclusive rights to use the content. The Sky Refinery can license the same content to other customers.
• Worldwide, meaning content can be used in any geographic territory.
• Unlimited, meaning you can use the content in an unlimited number of projects and in any media.

Examples of how you can use content include: websites, ads, marketing materials, presentations, publications, films, apps, packaging, etc. Please read the “Restricted Uses” section for exceptions.

Restricted Uses:

• No Unlawful Use. You may not use content in a pornographic, defamatory or other unlawful manner, to promote violence or hatred, or in violation of any applicable regulations or industry codes.
• No Standalone File Use. You may not use content in any way that allows others to download, extract, or redistribute content as a standalone file (meaning just the content file itself, separate from the project or end use).
• No Products for Resale. Unless you purchase an extended license, you may not use content in connection with any goods or services intended for resale or distribution where the primary value lies in the content itself including, without limitation, cards, stationery items, paper products, calendars, apparel items, posters (printed on paper, canvas, or any other media). This includes “on demand” products (meaning products in which content is selected by a third party for customization on such product on a made-to-order basis), including, without limitation, postcards, mugs, t-shirts, posters and other items. 
• No Electronic Templates. Unless you purchase an extended license, you may not use content in electronic or digital templates intended for resale or other distribution (for example, website templates, business card templates, electronic greeting card templates, brochure design templates).
• Limited print run. Unless you purchase an extended license, you may not reproduce the content more than 10,000 times in physical print form. This restriction does not apply to electronic reproduction.
• No False Representation of Authorship. You may not falsely represent that you are the original creator of an end use that is made up largely of licensed content. 
• No Machine Learning, AI or Biometric Technology Use. You may not use content (including any caption information, keywords or other metadata associated with the content) for any machine learning or artificial intelligence purposes, or for any technologies designed for or intended for the identification of natural persons.

Who Can Use the Images:

• Standard License: Only 1 user can use the image. Only you (or your employer/client) can use the images.  You cannot transfer or sublicense files to anyone else. You may not store the content on a server (giving more than one person simultaneous access to the content). 
• Extended License: Unlimited users within your company can access the image. 

Intellectual Property:

All content is owned by The Sky Refinery.  All rights not expressly granted in this agreement are reserved by The Sky Refinery.  

Refunds:

All products on our site are non-returnable, and non-refundable. If you are dissatisfied with your product, please let us know and we’ll work with you to make it right.

Warranties:

The Sky Refinery warrants that using the content as provided won’t infringe on any rights. However, we don’t guarantee the accuracy of image descriptions or metadata, and the content is provided “as is” without other warranties
